The Monroe Doctrine: The Duty to Defend under Texas Law and When Insurers Must Pay for Counsel (Jun 2023)

Construction disputes frequently trigger potential insurance coverage, and the duty to defend may be the single most important aspect of an insurance policy. This course addresses when a carrier’s duty to defend an insured arises under Texas law, and analyze in the context of construction disputes how courts are applying the holding in Monroe Guaranty Insurance Company v. BITCO General Insurance Corporation—the Texas Supreme Court’s most recent opinion governing this issue.

Protecting Individual Trustees Who Protect Beneficiaries (Apr 2023)

Trustee service should be carefully considered in advance of accepting such a role. Explore fiduciary duties and related liability concerns for trustees (both individual and corporate), as well as best (suggested) practices for individual trustees seeking to minimize risk.
